Welcome to HarvestCommons ("we," "us," or "our"). These Terms & Conditions ("Terms") regulate your use of our yacht charter services and the website available at harvestcommons.sbs (the "Service"), operated by HarvestCommons.
When reserving a charter or utilizing our Service, you consent to comply with these Terms. Should you not agree with any portion of these terms, then you should not use the Service.
2. Service Overview
HarvestCommons offers exclusive yacht charter services, which include:
- Day-long yacht rentals
- Evening sails
- Business getaways
- Exclusive gatherings
- Extended charters
Availability of services is contingent upon factors such as weather conditions. We retain the autonomy to change or stop services at our discretion.
3. Booking and Reservations
3.1 Booking Process
In order to reserve a charter, you must:
- Have attained the age of majority, 18 years old
- Supply truthful and comprehensive details
- Remit the necessary deposit as delineated in your booking confirmation
- Accept these Terms & Conditions
3.2 Confirmation
Confirmation of your booking is finalized upon payment receipt and our formal acknowledgment. We reserve the authority to decline service to anyone as we see fit.
3.3 Availability
Our charter offerings are contingent on the availability of the vessel and appropriate weather conditions. We will endeavor to accommodate your desired dates and times within reason.
4. Payment Terms
4.1 Pricing
All prices are stated in € and cover applicable taxes, unless indicated otherwise. These prices are subject to change without prior notice.
4.2 Payment Schedule
- Deposit: 50% of the total cost of the charter payable at the time of reservation
- Final Payment: Required 48 hours prior to the departure of the charter
- Extra charges (if applicable): To be paid upon the charter's completion
4.3 Payment Methods
We accept major credit cards, bank wires, and certified bank drafts. Our payment processing is done through secure, encrypted platforms.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- Over 72 hours before departure: Full refund less processing costs
- 24-72 hours before departure: Refund of 50%
- Under 24 hours before departure: No refund provided
5.2 Weather Cancellations
In case our captain concludes the weather is unsafe, we will propose to:
- Postpone your charter to an alternative available date at no extra charge
- Issue a full refund if rescheduling is impractical
5.3 Mechanical Issues
If there is a mechanical failure with the vessel that has been allocated to you, we will attempt to source a suitable substitution. Should a replacement not be available, a complete refund will be issued.
6. Safety and Conduct
6.1 Safety Requirements
All travelers must:
- Abide by all instructions given by the crew
- Use provided safety gear when deemed necessary
- Disclose any health conditions that may impact their safety
- Stay within the designated areas on the vessel
6.2 Prohibited Items
The following items are prohibited on board:
- Containers made of glass
- Illicit substances
- Weapons or firearms
- Excessive beverages (beyond a reasonable amount of non-alcoholic drink like juice or soft drinks)
- Animals (unless prior approval is obtained)
6.3 Conduct
Passengers are required to behave in a courteous and respectful manner. We maintain the right to terminate a charter without issuing a refund if the behavior of any passenger poses a threat to safety or disrupts the enjoyment of other guests.
7. Liability and Insurance
7.1 Our Liability
Our liability is limited to the amount paid for the charter service you booked. We are not accountable for:
- Personal harm stemming from negligence on the part of the traveler
- Theft or destruction of personal items
- Indirect or consequential losses, or punitive damages
- Delays due to weather or other factors beyond our control
7.2 Insurance Coverage
We have comprehensive marine insurance that covers our vessels and operations. Passengers should ensure they have their own travel and personal insurance.
7.3 Assumption of Risk
By choosing to participate in our charters, you acknowledge the inherent hazards associated with maritime activities and accept responsibility for your own safety and welfare.
8. Modifications and Itinerary Changes
We possess the right to alter itineraries, paths, or timetables based on factors like weather, safety, or operational considerations. We will strive to offer suitable alternative experiences where possible.
9. Force Majeure
We shall not be held responsible for delays, cancellations, or changes caused by events beyond our control, which include but are not limited to:
- Extreme weather events
- Natural catastrophes
- Government mandates
- Port closures
- Vessel malfunctions
10. Privacy and Data Protection
Your personal data is managed in line with our Privacy Policy. By availing of our services, you agree to the gathering and usage of your information as outlined in our Privacy Policy.
11. Intellectual Property
All content on our website, which includes but is not limited to text, graphics, logos, and imagery, is safeguarded by copyright and trademark legislations. Unauthorized reproduction, distribution, or creation of derivative works is prohibited without our express written approval.
12. Governing Law
These Terms are under the jurisdiction of the laws in Germany. Any legal disputes will be adjudicated in the courts situated in Hamburg, Germany.
